By purchasing and/or using any Optimal Beam software you agree to the following terms and conditions. If you do not agree to all the terms and conditions of this agreement, then you must not use the software.

  1. Results from any engineering software should always be double checked when applied in real-life applications. As an Optimal Beam user, it is your responsibility to validate the output of the software with some other independent means.
  2. Optimal Beam software results can only be used for design purposes when approved by a professional and competent engineer.
  3. You must provide your legal name, valid email address, and any other information requested to complete the registration process.
  4. Your license is limited to a single user. The sharing of an account with more than one user is prohibited. You will experience suspensions or termination if the account is used simultaneously in multiple locations or on multiple devices per month. This is to protect unlawful use of Optimal Beam software.
  5. You are responsible for maintaining the security of your account and password. Optimal Beam will not be liable for any loss or damage from your failure to comply with security obligations.
  6. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction.
  7. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the Service without the express written permission by Optimal Beam.
  8. Technical support is only provided to paying account holders and is only available via email.
  9. You understand that Optimal Beam uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
  10. Optimal Beam software are not to be redistributed as the work of another party. The beam software and calculators are all the intellectual property of Optimal Beam. Any violations of this will be considered an infringement of Copyright laws.
  11. You agree to accept communication in the form of personal and marketing emails. You can opt out of these by unsubscribing in your account settings.
  12. Optimal Beam reserves the right to use your files for marketing purposes in the form of visual representation. You may opt out by contacting us. Optimal Beam will never release your information to a third party without your permission.
  13. There are millions of possible iterations such as various supports types, loading conditions, members lengths, material types and sections properties. This makes it impossible to test and ensure accuracy in all possible scenarios. As a user, you understand that although Optimal Beam Software has been tested with 100% accuracy, the risk of deviated solutions due to software functioning incorrectly is still possible.
  14. Optimal Beam shall make reasonable efforts to make the services available 24 hours a day, 7 days a week, except for (a) planned downtime, (b) any unavailability caused by circumstances beyond our reasonable control, including without limitation, acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labor problems, Internet service provider failures or delays, or denial of service attacks.
  15. Payment is in the form of a period subscription, which gives Optimal Beam permission to auto-bill and charge your account according to the agreed subscription.
  16. If you wish to stop your subscription, then simply cancel your subscription which is done in the account settings. There is no lock-in contract and you are free to cancel your subscription at any time. There are no cancellation fees. However, there are no refunds. If you paid for the current period, then the payment is final, and your account will remain for the duration of the paid term.
  17. The license will be activated once payment is received in full. You are responsible for keeping your billing information up to date by notifying us of any changes.
  18. The Optimal Beam Basic Account is discounted software which must be used for educational purposes and under no circumstances for commercial use.
  19. The price of the subscription is that which is agreed to at the time that the account is created, and which may increase by the sole discretion of Optimal Beam at the start of a new billing period by notifying the user in advance.
  20. Optimal Beam may change/modify the product automatically over time without notice and shall not be under any obligation to provide you with any notification of such change.
  21. Optimal Beam has the right to make any changes to free accounts / free software at any time, without notice.
